SPONSOR. The Sponsor of this Sweepstakes is F50 League LLC, 475 Sansome Street, 12th Floor, San Francisco, CA 94111 (“Sponsor”).
ENTRY PERIOD. This Sweepstakes entry period begins on April 26, 2019 and ends at 12:00 a.m. PT on April 30, 2019 (the “Entry Period”).
ELIGIBILITY. This Sweepstakes is open only to individual legal residents of the United States of America (including its territories and possessions) who are 18 years or older as of the date of entry into the Sweepstakes. Employees and non-employee workers of Sponsor, Oracle Racing, Inc., and each of their respective affiliates, officers, directors, employees, agents, the judges, and members of each of their immediate families (i.e. spouses, parents, children and siblings, and their respective spouses) and those living in the same household of each are not eligible to enter this Sweepstakes. This Sweepstakes is subject to all applicable laws and regulations and is void where prohibited by law or regulation.
HOW TO ENTER.
4.1. Online Entry: During the Entry Period, go to www.surveygizmo.eu/s3/90141022/Sail-GP-San-Francisco-Ticketing-Survey and complete the survey. By successfully transmitting a completed survey as directed, you will be entered in the Sweepstakes. There are no other methods of entry. All information submitted online is subject to the Sponsor’s Privacy Policy, available at www.sailgp.com/privacy. Incomplete or inaccurate entry forms will not be accepted and are void. All entries must include a valid email address for the entrant. LIMIT OF ONE (1) ENTRY PER PERSON.
4.2. No Other Methods of Entry: Any attempted form of entry other than as described herein is void. Entries in violation of these Official Rules, as determined by Sponsor in its sole discretion, will be disqualified. Only entries received by the end of the Entry Period will be considered. Any entry that includes illegal, false, or fraudulent information, obscenities, objectionable material, or which defames or otherwise infringes upon any third party’s personal or proprietary rights, as determined by Sponsor in its sole discretion, will be disqualified. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses or identities will void such entries and that entrant may be disqualified, as determined by Sponsor in its sole discretion.
- SELECTION OF WINNER.
5.1. Random Drawing: The potential winner (“Potential Winner”) of the Sweepstakes will be determined from all eligible entries in a random drawing that will take place as soon as practicable following the end of the Entry Period, but in no event later 10:00 a.m. Pacific Time on May 2, 2019.
5.2. In the event there are no entries during the Entry Period, there will be no drawing and the Prize will not be awarded.
5.3. Notification: The Potential Winner will be notified by email to the email address provided with the Potential Winner’s entry. The Potential Winner must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements. If the Potential Winner fails to respond by email to the Sponsor within seven (7) days of notification, the Potential Winner shall be deemed to have forfeited the Prize. The Potential Winner shall be required to provide his or her name, address, age and other necessary information to verify eligibility and receive the Prize. Further, Sponsor may request and Potential Winner agrees to provide an affidavit of eligibility and liability/publicity release covering eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. A Prize will not be awarded until necessary information has been collected and all properly executed forms are returned (“Verification”). Upon completion of Verification a Potential Winner shall become a winner (“Winner”). The decisions of Sponsor are final and binding on all matters relating to this Sweepstakes.
5.4. Odds: The odds of winning the Sweepstakes depends on the total number of eligible entries received.
- PRIZE
6.1. The Winner will receive four (4) tickets in total for grandstand seating at the SailGP San Francisco event to be held on May 4-5, 2019: two (2) tickets for May 4th and two (2) tickets for May 5th. Grandstand ticket terms and conditions are available here.
6.2. Taxes, if any, are the sole responsibility of the Winner. No other substitution or transfers of Prize are permitted. Sponsor is responsible only for Prize delivery, and is not responsible for Prize utility, quality or otherwise.
6.3. THE PRIZE DOES NOT INCLUDE TRANSPORTATION TO OR FROM THE SAILGP SAN FRANCISCO EVENT OR ACCOMMODATION/LODGING.
- ADDITIONAL CONDITIONS OF ENTRY
7.1. By entering this Sweepstakes, each entrant shall be deemed to have been made aware of these Official Rules and to have accepted and agreed to comply with and be bound by these Official Rules which are final and binding in all matters related to the Sweepstakes.
7.2. Sponsor reserves the right to disqualify any entry into this Sweepstakes (and void all associated entries) or entitlement to a Prize if, in the sole discretion of Sponsor, it determines or suspects that an entrant has attempted to undermine the legitimate operation of the Sweepstakes.
7.3. Sponsor reserves the right in its sole discretion to cancel, modify or suspend Sweepstakes at any time with or without notice if fraud, technical failures (including any network server or hardware failure), viruses, bugs, errors in programming, or any other causes corrupt the administration, security or integrity of this Sweepstakes. In the event of cancellation, Sponsor reserves the right to select a Potential Winner from among all eligible, non-suspect entries received up to the time of such cancellation.
7.4. Any attempt by any entrant or other individual to deliberately damage any website or undermine the legitimate operation of this Sweepstakes, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should any such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney’s fees) from any such individual, to the fullest extent permitted by law, including criminal prosecution. An entrant engaging in any of the foregoing activities may be disqualified (and all associated entries will be void) and will forfeit any Prize won.
7.5. Sponsor does not warrant that access to this Sweepstakes will be uninterrupted. Sponsor is not responsible for, and you hereby waive any claim arising from, any problems that may arise, including, without limitation: (i) inaccessible or unavailable networks, websites, or other connection or accessibility problems; (ii) failed, delayed or misdirected communications, including any lost, late, stolen, incomplete, illegible or undelivered entries; (iii) technical malfunctions, printing, clerical, or other errors in connection with the administration of this Sweepstakes or the offering or announcement of any Prize; (iv) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with this Sweepstakes; (v) damage to a user’s system occasioned by participation in this Sweepstakes; or (vi) any other errors of any kind relating to, or in connection with this Sweepstakes.
- LIMITATIONS OF LIABILITY AND RELEASE.
8.1. As a condition of entering, you agree: (i) to release the Sponsor from any and all liability, loss or damage incurred with respect to participating in this Sweepstakes or the awarding, receipt, possession, and/or use or misuse of any Prize or activity related thereto; (ii) that under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, consequential, or any other damages (other than for actual out-of-pocket expenses) from Sponsor, (iii) all causes of action arising our of or connected with this Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action; and (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and in no event will you be entitled to receive attorney’s fees or court costs. Some jurisdictions may not allow certain limitations on damages or the ability to seek damages through a class action, so some of these restrictions may not apply to you.
PUBLICITY RELEASE. Participation in this Sweepstakes and/or acceptance of any Prize constitutes permission for Sponsor to use, without notice or further compensation, worldwide and in perpetuity, any entrant’s entry, photo, likeness, biographical information, including, without limitation, advertising and promotional purposes as well as in, on or in connection with Sponsor’s website or this Sweepstakes, and entrant hereby releases the Sponsor Entities from any liability with respect thereto (each a “Publicity Release”).
DISPUTES. Disputes, including construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of California without regard to choice of law or conflict of law principles (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Any dispute, claims and causes of action arising out of or connected in any way with this Sweepstakes or any Prize(s) awarded shall be resolved individually, without resort to any form of class action, and brought exclusively in a federal or state court in the county of San Francisco in the state of California. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees. Under no circumstances will an entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. In the event of any conflict with the details of the Sweepstakes contained in these Official Rules and Sweepstakes details contained in other materials (including, without limitation, any Entry Announcement or any point of sale, online or print advertising), the details of Sweepstakes as set forth in these Official Rules shall prevail.
